Welcome to Weedys. Weedys LLC and its affiliates (“Weedys”) provide website features, products, and services when you visit Weedys.com, use Weedys products or services, use Weedys applications for mobile, or use software provided by Weedys in connection with any of the foregoing (collectively, “Weedys Services”). By using Weedys Services, you agree to these Conditions of Use on behalf of yourself and all members of your household and others who use any Service under your account.

Electronic Communications and Marketing Consent

By creating a Weedys account or using Weedys Services, you agree to receive communications from Weedys electronically, including but not limited to emails, text messages, push notifications, and other digital communications. These communications may include account updates, transaction confirmations, promotional offers, and other marketing materials.

Consent Requirements:

1. Mandatory Consent: Enrollment in the Weedys Rewards Program or use of Weedys Services requires you to consent to receive marketing communications. Weedys may use your contact information, including email address and phone number, to send promotional materials and other updates.
2. Opt-Out Option for Marketing: You may withdraw consent to receive marketing communications by following the opt-out instructions included in the communication (e.g., clicking an “unsubscribe” link in emails or replying “STOP” to text messages).
   Opting out of marketing communications will not affect your ability to receive transactional or account-related communications necessary for managing your Weedys account or participation in the Rewards Program.
3. Text Message Consent (SMS): You may opt in to text messages from Weedys regarding account updates, promotional offers, and other communications. Msg & data rates may apply. To opt out, change your notification settings in your account on our website or reply “STOP” to any text message from Weedys. Replying with 'STOP' is a permanent opt-out that is controlled by SMS providers so we are unable to undo this. If you may want to opt back in to text messages in the future please opt out by updating your Weedys account settings.
4. Legally Required Disclosures: Weedys will comply with all applicable laws, including the CAN-SPAM Act, TCPA, and state or federal privacy regulations. Weedys will not share your contact information with third parties for independent marketing purposes without your explicit consent.
5. Conditions for Participation: Refusing or withdrawing consent for electronic communications may result in suspension or termination of your Weedys account or program participation, as certain communications are essential for the operation of the Rewards Program.

Copyright and Trademarks

All content included in or made available through any Weedys Service is the property of Weedys or its content suppliers and is protected by United States and international copyright laws. Weedys’ trademarks may not be used in connection with any product or service that is not Weedys’, in any manner likely to cause confusion among customers, or in any manner that disparages or discredits Weedys.

License and Access

Subject to your compliance with these Conditions of Use and payment of applicable fees, Weedys may grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of Weedys Services. This license prohibits any resale or commercial use of Weedys Services or content, any data mining or extraction, or any use of Weedys Services for the benefit of another business. Weedys may terminate this license at its sole discretion if any prohibited activities are detected.

Your Account

You may need a Weedys account to use certain Weedys Services. You are responsible for maintaining the confidentiality of your account and password. Weedys may refuse service, terminate accounts, or cancel orders at its discretion, particularly in cases of fraudulent activity, misuse, or policy violations.

Reviews, Comments, and Other Content

You may post reviews, comments, and other content as long as it is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing intellectual property rights, or otherwise injurious to third parties. Weedys may remove or edit content at its discretion and reserves the right to ban violators from Weedys Services. By submitting content, you grant Weedys a non-exclusive, royalty-free, perpetual right to use, reproduce, modify, and distribute the content in any format.

Risk of Loss and Returns

The risk of loss and title for items purchased from Weedys pass to you upon delivery to the carrier. Weedys may offer optional shipping insurance for additional protection. For details, please refer to our Returns Center.

Product Descriptions and Pricing

Weedys attempts to ensure product descriptions are accurate but does not warrant that descriptions, prices, or availability are error-free. Weedys may correct errors and reserves the right to cancel orders affected by pricing discrepancies, notifying customers within a reasonable timeframe.

Age Restrictions

Weedys does not sell cannabis products to anyone under the age of 21. By using Weedys Services, you confirm that you are at least 21 years old. Weedys may request additional verification to confirm compliance with this requirement.

Compliance with Laws

You agree to comply with all applicable laws and regulations regarding the purchase, possession, and use of cannabis products. Weedys may deny services or cancel transactions that do not comply with legal requirements.

Disclaimer of Warranties and Limitation of Liability

Weedys Services are provided "as is." Weedys may disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Weedys may not be liable for any damages arising from the use of Weedys Services, except as required by applicable law.

Disputes

Any dispute relating to your use of Weedys Services may be resolved in the state or Federal courts in Michigan, and you consent to exclusive jurisdiction and venue in these courts. Weedys may require disputes to be resolved through binding arbitration under the rules of the American Arbitration Association.

Applicable Law

By using Weedys Services, you agree that the laws of the state of Michigan, without regard to principles of conflict of laws, will govern these Conditions of Use.

Changes to Conditions of Use

Weedys reserves the right to modify these Conditions of Use, its site, or its policies at any time. Significant changes may be communicated to users via email or posted on Weedys Services. Continued use of Weedys Services after changes are made constitutes acceptance of the updated terms.
