1. Introduction
This document constitutes a binding agreement (“Terms,” “Terms of Use,” or “Agreement”) between you (“User” or “you”) and TC MI LLC, a Michigan limited liability company, doing business as “Weedys” (“Weedys,” “us,” “we,” or the “Company”). These Terms govern your access to and use of Weedys’ Services, including but not limited to physical retail operations, delivery services, digital services, and any related content or features. By accessing or using any of our Services, you agree to comply with these Terms in full.
2. Scope of Services
These Terms apply to the following:
- Retail and Age Verification Services: Retail sales and age verification in Weedys-branded or owned locations (“Stores”).
- Delivery Services: Physical delivery of products to customers.
- Digital Services: Services provided through Weedys’ website located at weedys.com (the “Website” or “Site”), mobile applications, and electronic communications delivered by us or our partners.
By using these Services, you confirm your agreement to these Terms. If you do not agree, you must refrain from using the Services.
3. Eligibility
You must be at least 21 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.
4. Changes to the Terms
Weedys reserves the right to modify these Terms at any time. Updates will be posted on the Website, and it is your responsibility to review these Terms regularly. Your continued use of the Services after changes have been posted constitutes your acceptance of the revised Terms.
5. User Obligations
By using our Services, you agree to:
- Comply with all applicable local, state, and federal laws and regulations, including Michigan state law governing cannabis-related activities.
- Refrain from using the Services for any illegal or unauthorized purpose.
- Provide accurate, current, and complete information during any registration process or transaction with Weedys.
6. Product Use and Compliance with Law
Weedys provides products in strict accordance with Michigan law and federal law where applicable. It is your responsibility to ensure that the use of our products complies with local and federal laws in your jurisdiction. Weedys disclaims any liability for misuse of its products in violation of any laws.
7. Age Verification
Weedys strictly enforces age restrictions in compliance with applicable laws. Users may be required to provide valid identification for the purpose of verifying age. Any attempt to bypass age verification or provide false identification is grounds for termination of access to our Services.
8. Dispute Resolution and Arbitration

- Mandatory Arbitration You agree that any dispute arising from or related to your use of Weedys Services will be resolved through binding individual arbitration in accordance with the Federal Arbitration Act (FAA) and the American Arbitration Association (AAA) rules. The arbitration will take place in the State of Michigan. This means you waive your right to litigate disputes in court, including a jury trial.
- Class Action Waiver: All disputes must be resolved on an individual basis. You agree not to bring a claim as a plaintiff or class member in a class, consolidated, or representative action.
- Exceptions: You may pursue claims in small claims court for disputes within its jurisdiction or file complaints with relevant government agencies.
9. Limitation of Liability
To the fullest extent permitted by law, Weedys, its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or any other damages arising from your use of our Services. Weedys’ total liability to you for any cause of action will be limited to the amount you paid for the Services that gave rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Weedys, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, any violation of these Terms, or your violation of any applicable law or regulation.
11. Intellectual Property
All content, materials, trademarks, and other intellectual property provided through Weedys Services, including the Website, are the exclusive property of Weedys or its licensors. You may not reproduce, distribute, modify, or create derivative works from any Weedys content without our prior written permission.
12. Termination of Access
Weedys reserves the right to suspend or terminate your access to the Services at its sole discretion, without notice, if you violate these Terms or engage in any conduct deemed harmful to the Company.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. Any dispute or legal action related to these Terms will be brought exclusively in the state or federal courts located in Michigan.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
15. Force Majeure
Weedys is not liable for any delay or failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, acts of war, or government restrictions.
16. Payment Terms
By placing an order, you agree to pay all applicable fees and charges, including but not limited to taxes and a 3% processing fee for credit card payments. Weedys reserves the right to change its pricing and payment terms at any time, with notice posted on the Website.
17. Privacy Policy
Your use of the Services is also governed by Weedys’ Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for details on how we collect, use, and protect your information.
